The General Terms and Conditions of Sale regulate the relationship for the distance sale between COMPEGPS TEAM S.L. and the user or customer, as required by law, and in particular Law 7/1998 of 13 April on General Terms and Conditions of Sale, Law 3/2014 of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, Royal Decree 1906/1999 of 17 December 1999, which governs the general terms for Telephone and Electronic sales, Organic Law 15/1999 of 13 December on the Protection of Personal Information, Law 7/1996 of 15 January on Retail Commerce, and Law 34/2002 of 11 July on the Services of the Information Society and Electronic Commerce.

If a purchase amount is fraudulently or incorrectly charged using your credit card number, you can demand that the charge be immediately cancelled. In this case, the amount will be refunded to your account as quickly as possible. However, if the purchase was in fact made by you, as the owner of the card, and the return is not demanded as a consequence of exercising your right of withdrawal or of termination, then your request to cancel the charge will be deemed to be improper, and as a result you will be liable to COMPEGPS TEAM S.L. for any damages and harm caused as a result of said cancellation.

COMPEGPS TEAM S.L. is committed to shipping your order the day after it is placed.

The availability of products offered by COMPEGPS TEAM S.L. may vary depending on customer demand. Although COMPEGPS TEAM S.L. periodically replenishes its stock, the product you request may be temporarily out of stock. If a product is not available, COMPEGPS TEAM S.L. will inform you via email as soon as it becomes aware of this situation. This information will be sent no later than 30 days. COMPEGPS TEAM S.L. may then offer to 1) provide the customer with another product of similar or better characteristics, or 2) unless COMPEGPS TEAM S.L. provides justifiable and provable reasons, refund the payment made for the cancelled order. In the event that COMPEGPS TEAM S.L. does not refund the amount within the period stipulated, you may demand to be paid twice the amount owed, without prejudice to your right to other compensation.

Right of withdrawal, returns and claims

Returns

All products must be returned directly to COMPEGPS TEAM S.L. at C/ Draper 13 08350, Arenys de Mar, Barcelona (Spain) with no undue delays, and in any case within fourteen calendar days from the date when the right of withdrawal is formally claimed. This period will be deemed to be satisfied if you return the product before the period expires.

The cost of returning the product is your responsibility.

The products returned must be in perfect condition, unused and in their original packaging. To avoid problems during shipping, we ask that you please make sure the parcel is properly protected and sealed. Once received, we will check its/their condition. Once we confirm that the item(s) and any associated components, accessories, promotional gifts and documentation are complete and in good condition, we will issue you a refund.

Refunds

Any amounts received from you will be refunded using the same method of payment employed by you, unless otherwise stipulated. COMPEGPS TEAM S.L. may withhold the refund until it receives the product, the reason for withdrawal, or until you provide the the return form, whichever condition applies first.

In the event of an unjustified delay by COMPEGPS TEAM S.L. in issuing a refund, you may claim twice the amount paid, without prejudice to be compensated for any damages claimed in excess of said amount.

Returning a faulty product

If the product is not in good condition for reasons not attributable to you, you will be entitled to return the product, at no cost to you, after informing COMPEGPS TEAM S.L. of the reason for the return using any of the methods described in the previous conditions. This return due to the faulty or improper condition of the product shall not be regarded as a right to withdrawal.

The COMPEGPS TEAM S.L. will pay for the return costs and exchange it with a new product, as per the conditions accepted at the time when the sale is finalised. Any dispute between the parties may be subjected to arbitration or to the regular courts, in compliance with the relevant regulations on jurisdiction.
